Terms of Service

1. Account and Eligibility

• You must be at least 16 years old to use the Service.
• You are responsible for the accuracy of registration information and for maintaining the confidentiality of credentials, tokens, and devices used to access the Service.
• If you use the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization and that "you" refers to both the organization and the individual user.

2. Google OAuth and Gmail Access

• When connecting Google accounts, the Service uses OAuth to obtain access and refresh tokens. Tokens are used solely to provide the Service and may be refreshed automatically while your connection is active.
• When you invoke features that analyze emails, the Service may read email threads, subject lines, message body text, timestamps, and non‑inline attachments metadata; attachments may be downloaded/processed as necessary to provide requested functionality.
• The Gmail Add‑on shows suggested replies; it does not send messages on your behalf. You are responsible for reviewing and using any suggested content.

3. Your Content and Licenses

• You retain ownership of content you submit or upload (including documents and email content). You grant us a worldwide, non‑exclusive, royalty‑free license to host, process, store, reproduce, and display such content as necessary to operate and improve the Service.
• You represent and warrant that you have the necessary rights to submit the content and that your submission complies with applicable law and these Terms.

4. AI Services and Output

• The Service uses third‑party AI providers (e.g., OpenAI) to analyze content and generate suggested replies. By using AI features, you authorize transmission of relevant text and metadata to such providers for processing.
• AI outputs may be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing outputs and for decisions made based on them.
• Unless otherwise prohibited by your organization's policy, you may use the outputs for your business purposes, subject to any usage policies of third‑party providers.

5. Storage and Embeddings

• Uploaded documents may be stored in cloud object storage (e.g., AWS S3). Time‑limited links may be generated for downloads.
• To enable semantic search and context, the Service generates vector embeddings (e.g., via Chroma) from your content and stores associated metadata. Deleting a document removes its related embeddings.

6. Acceptable Use

• No use that violates law or infringes others' rights.
• No reverse engineering, scraping, or interfering with the Service.
• No uploading unlawful, harmful, or malicious content or code.
• Do not submit highly sensitive personal data (e.g., special category data under GDPR, payment card data, protected health information) unless you have a lawful basis and appropriate safeguards in place.

7. Subscriptions and Payment

If paid plans are offered, fees, billing cycles, and taxes will be disclosed at checkout. Unless stated otherwise, subscriptions renew automatically until canceled. You remain responsible for charges incurred before cancellation takes effect.

8. Privacy

Our Privacy Policyexplains how we collect and process personal data. By using the Service, you consent to those practices.

9. Third‑Party Services

The Service integrates with third parties including Google (OAuth/Gmail), OpenAI (AI processing), AWS S3 (storage), and Chroma (vector database). Your use is also subject to those providers' terms and policies. We are not responsible for third‑party services.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR‑FREE OR THAT OUTPUTS WILL BE ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to your content, your use of the Service, or your violation of these Terms or applicable law.

13. Termination

We may suspend or terminate access to the Service at any time for any conduct that, in our reasonable judgment, violates these Terms or is harmful to other users or the Service. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination shall so survive.

14. Governing Law; Disputes

These Terms are governed by the laws of Germany, without regard to conflict‑of‑law principles. You agree to the exclusive jurisdiction and venue of the courts located in Berlin, Germany, for disputes arising out of or relating to these Terms or the Service.

15. Changes to the Service or Terms

We may update the Service and these Terms from time to time. If changes are material, we will provide notice through the Applications or by email where appropriate. Your continued use constitutes acceptance of the updated Terms.
